1. Respect for Intellectual Property

Homixar, operated by Yonda Solutions LLC, respects the intellectual property rights of others and expects our users to do the same. We comply with the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws.

3. Filing a DMCA Takedown Notice

If you believe that content on Homixar infringes your copyright, you may submit a DMCA takedown notice. Your notice must include:

1. Physical or electronic signature of the copyright owner or authorized representative
2. Identification of the copyrighted work claimed to be infringed (or a representative list if multiple works)
3. Identification of the infringing material and information reasonably sufficient to locate it (e.g., URL)
4. Your contact information: name, address, telephone number, and email address
5. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
6. A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the owner

4. Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification. Your counter-notice must include:

1. Your physical or electronic signature
2. Identification of the removed material and its location before removal
3. A statement under penalty of perjury that you have a good faith belief that the material was removed by mistake or misidentification
4. Your name, address, and telephone number
5. A statement that you consent to the jurisdiction of the federal court in the Southern District of New York (or your local federal district if outside the US)
6. A statement that you will accept service of process from the person who filed the original DMCA notice

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, we may restore the removed content.

5. Repeat Infringer Policy

Homixar will terminate, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights. We consider the following:

• Number of valid DMCA notices received against a user
• Nature and severity of the infringement
• User's response to prior notices
• Counter-notifications filed and their validity

Typically, accounts receiving three or more valid DMCA notices may be permanently terminated.

6. Types of Protected Content

The following types of content may be subject to copyright protection:

• Photographs: Portfolio images, before/after photos, profile pictures
• Written Content: Service descriptions, bio text, blog posts
• AI-Generated Images: While ownership varies, unauthorized use of others' AI creations may be prohibited
• Logos and Branding: Business logos, marketing materials
• Videos: Tutorial videos, promotional content

7. What is NOT Copyright Infringement

The following generally do NOT constitute copyright infringement:

• Using your own original photos and content
• Content you have license or permission to use
• Stock photos with proper licensing
• Fair use (criticism, commentary, news reporting, teaching, research)
• Ideas, facts, or concepts (copyright protects expression, not ideas)
• Content in the public domain

• Description of the trademark
• Location of the allegedly infringing content

9. AI-Generated Content

Regarding AI-generated content on our platform:

• Users own the AI-generated images they create using their own input images
• You may not use others' images to generate AI content without permission
• The underlying AI models are licensed technology and cannot be copied or extracted
• Homixar retains no ownership of user-generated AI content

10. How We Handle Reports

When we receive a DMCA notice:

1. We review the notice for completeness
2. If valid, we remove or disable access to the allegedly infringing content
3. We notify the user who posted the content
4. We provide information about filing a counter-notification
5. We keep records of all notices and actions taken

Typical response time: 1-3 business days for initial review.

11. Good Faith and Abuse

We take copyright seriously but also protect against abuse:

• We do not tolerate fraudulent DMCA notices
• Abuse of the DMCA process may result in legal liability
• We may share information about fraudulent notices with affected parties
• Repeated fraudulent notices may result in being blocked from our platform

12. International Users

While we comply with the US DMCA, we also respect international copyright laws. Users outside the US should note:

• We may comply with valid takedown requests under local laws
• International treaties (Berne Convention, WIPO) may apply
• Different jurisdictions may have different procedures
